Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Lytes website, products and services (the “Services”). By visiting our site and/or purchasing from us, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced here or displayed at checkout.
In these Terms, “Lytes”, “we”, “us” and “our” refer to the site operator. “you” and “your” refer to the customer or user.
Nothing in these Terms limits your rights under the Australian Consumer Law (“ACL”).

1. Overview & updates
We operate this website on the Shopify platform. We may update these Terms at any time by posting a new version on this page. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
2. Eligibility & conduct
- You must be at least the age of majority in your state or territory, or have consent from a parent/guardian.
- You must not use the Services for unlawful or unauthorised purposes, introduce malware, or attempt to interfere with security.
- Consumer purchases only: we may limit quantities to a maximum of 6 units per product, per household, per month.
3. Site information & accuracy
Content is provided in good faith for general information. We may correct errors, update information or change availability without notice. Historical information may not be current.
4. Pricing, GST & promotions
- All prices are in AUD and, unless stated otherwise, include GST.
- Prices, shipping rates and promotions can change without notice. Adjustments do not apply retroactively to completed orders.
- Promo codes/gift cards cannot be redeemed for cash, may have expiry dates and individual terms, and may not be combined unless we state otherwise.
5. Products, descriptions & availability
We aim to display colours and images accurately; actual colours may vary by device. We may limit or discontinue products at any time. If a product you ordered is unavailable, we’ll contact you to cancel with a full refund or propose an alternative.
6. Orders, payment & account details
- We may accept, refuse, cancel or limit orders at our discretion (e.g., suspected fraud, reseller activity, stock issues, address problems).
- You authorise us to charge the payment method provided for the order total, including shipping and applicable taxes.
- Please ensure your name, email, phone, billing and delivery address are current and accurate.
- Digital wallets: PayPal, Apple Pay and Google Pay may override the address you enter with the address stored in their systems. Confirm the final delivery address before paying.
7. Shipping, risk & delivery
- We ship via Australia Post and other reputable carriers. Dispatch and delivery timeframes are estimates only.
- Risk in goods passes to you on delivery to the address supplied (or when left under Authority to Leave). Title passes on full payment.
- For pre-orders or back-orders, we’ll provide estimated dispatch windows and keep you updated if delays occur.
- International orders may attract duties/taxes payable by you; we are not responsible for customs delays.
8. Authority to Leave
If you select Authority to Leave, the parcel may be left unattended at your address. The parcel is deemed received when left. We and our delivery partners are not responsible for loss or damage resulting from this method.
9. Return to Sender policy
When a parcel is returned as “Return to Sender”
If your parcel is returned to us by Australia Post or another courier (e.g., incorrect/incomplete address, uncollected or refused delivery), the following apply:
9.1 Customer responsibility
- Enter your delivery address correctly and completely at checkout.
- Digital wallets: Verify the final address shown before payment.
- Check your order confirmation immediately and contact us if you need a correction before dispatch.
We are not responsible for delays, losses or returns caused by incomplete or incorrect address details provided by you or your payment provider.
9.2 Returned-shipping costs
Carrier return fees are your responsibility.
9.3 Reshipping
A flat reshipping fee of $20 applies within Australia (higher for international). This covers the new outbound shipment plus the carrier’s original return fee. We’ll confirm your address and send a payment link before reshipment. Express options are available at additional cost.
9.4 Refunds for returned orders
If you prefer a refund—or we do not hear from you within 7 days after contacting you—we’ll refund the product value only, less a $10 Return to Sender fee and a 10% restocking fee. Original shipping charges are non-refundable.
9.5 Product condition
Returned items must be unopened and in resaleable condition. Opened, damaged or otherwise unsaleable goods may be ineligible for refund.
9.6 Timeframe & storage
Returned parcels are held for 7 days from the date we contact you. After that, we process the refund per 9.4 and close the order.
9.7 Contact
If your parcel has been returned, reply to our notification email or contact info@lytes.com.au with your order number.
10. Returns, refunds & ACL
Your rights under the ACL apply in addition to our store policy. If a product has a major failure, you are entitled to a replacement or refund and compensation for any reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the goods repaired or replaced within a reasonable time.

11. Third-party tools & links
We may provide access to third-party tools “as is” and links to external sites. We are not responsible for their content, availability or policies; please review their terms and privacy policies.
12. Reviews & user content
If you submit reviews, comments or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with the Services. You must not submit unlawful, misleading, defamatory, obscene or infringing material, or impersonate another person. We may moderate or remove content at our discretion.
13. Intellectual property
All content on the site (including text, graphics, logos, product names, images and code) is owned by or licensed to us and protected by Australian and international laws. You may not reproduce, copy or exploit any part of the Services without our prior written consent.
14. Warranties & liability
Except for any non-excludable guarantees under the ACL, the Services are provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all warranties, representations and conditions not expressly set out in these Terms, and we exclude liability for indirect or consequential loss, loss of profit, revenue, savings, or data.
Where liability cannot be excluded under the ACL, and to the extent permitted by law, our liability is limited to (at our option) replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
15. Indemnity
You agree to indemnify and hold Lytes and our officers, employees, agents and suppliers harmless from claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or applicable laws, or your misuse of the Services.
16. Force majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control (including natural disasters, epidemics, labour disputes, carrier delays, or platform outages).
17. Privacy
Your personal information is handled in accordance with our Privacy Policy. Credit card data is processed by PCI-compliant providers; we don’t store full card details.
18. Suspension & termination
We may suspend or terminate access if you breach these Terms. Obligations accrued up to termination survive (including payment, limitations of liability and indemnities).
19. Governing law & disputes
These Terms are governed by the laws of New South Wales, Australia. You agree to the non-exclusive jurisdiction of the courts of NSW and the Federal Court of Australia sitting in NSW. If an issue arises, please contact us first; you may also seek assistance from NSW Fair Trading or, where appropriate, apply to NCAT.
20. General
- Entire agreement: These Terms and any policies on our site constitute the entire agreement between you and us regarding the Services.
- Severability: If any provision is invalid or unenforceable, it will be severed and the remainder will continue in effect.
- No waiver: A failure to exercise or enforce a right is not a waiver of that right.
- Assignment: We may assign or transfer our rights and obligations at any time. You must not assign without our consent.
- Interpretation: Headings are for convenience only and do not affect interpretation.
